1. Service Description

SCART (Secure Communication Assessment Rail Track) is a cloud-based platform for assessing safety-critical rail communications against NR/L3/OPS/301 standards. The service is provided by PiPcall Ltd ("we", "us", "our") to subscribing organisations ("you", "your organisation").

2. Acceptance

By accessing or using SCART, you agree to be bound by these terms. If you are using the service on behalf of an organisation, you represent that you have authority to bind that organisation.

5. Assessment Accuracy

SCART provides automated assessment to assist human assessors. All grades and scores should be reviewed by a competent person before being used for competence decisions per NR/L3/OPS/301/03 Clause 7. SCART does not replace human judgement in safety-critical competence determinations.

6. Data Ownership

You retain ownership of all data you submit to SCART, including audio recordings, transcripts, and assessment results. We process this data solely to provide the service. Upon termination, your data will be exported and deleted per the data retention schedule in our Privacy Policy.

7. Intellectual Property

The SCART platform, assessment engine, and associated algorithms are the intellectual property of PiPcall Ltd. Your subscription grants a non-exclusive, non-transferable licence to use the service for the duration of your subscription.

8. Service Availability

We target 99.9% uptime for the SCART platform. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors outside our control.

9. Limitation of Liability

SCART is a decision-support tool. We are not liable for safety incidents, competence decisions, or regulatory outcomes based on SCART assessments. The responsibility for safety-critical communications competence remains with the employing organisation per the Railways and Other Guided Transport Systems (Safety) Regulations 2006.

10. Termination

Either party may terminate the service with 30 days' written notice. Upon termination, we will provide a full data export and delete your data within 90 days, unless retention is required by law.

11. Governing Law

These terms are governed by the laws of England and Wales.
